These Terms of Service ("Terms") govern your access to and use of plantidentify.org and the related plant identification tools, credits, subscriptions, and services provided by Plant Identify (the "Service"). By using the Service, you agree to these Terms.

1. Eligibility and Accounts

  • You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Service.
  • You agree to provide accurate account information and keep your login credentials secure.
  • You are responsible for activity that occurs under your account.

2. Plant Identification Service

  • The Service uses AI to analyze uploaded plant images and provide likely identification results and related plant information.
  • Results are informational only and may not always be correct, complete, or suitable for scientific, medical, toxicological, or emergency decisions.
  • You should use independent judgment before relying on any result for safety, ingestion, treatment, pet exposure, or legal compliance.

3. Credits, Purchases, and Subscriptions

  • Certain features may require credits or an active subscription.
  • Each identification or premium feature may consume credits as displayed on the site at the time of use.
  • Prices, credit requirements, and subscription benefits may change prospectively.
  • Payments are processed by third-party providers, and we do not store complete payment card details.

4. User Content

  • You retain ownership of the images and content you upload.
  • You grant us a limited license to host, process, analyze, and display your uploads only as needed to operate and improve the Service.
  • You represent that you have the right to upload the content you submit and that it does not violate laws or third-party rights.

5. Acceptable Use

  • You may not use the Service for unlawful, abusive, fraudulent, infringing, or harmful purposes.
  • You may not upload, submit, or process NSFW, adult, sexual, nude, pornographic, or otherwise sexually explicit content through the Service.
  • You may not attempt to reverse engineer, disrupt, overload, scrape, or bypass security or rate limits.
  • You may not upload malicious files, deceptive content, or content that violates the rights of others.

6. Intellectual Property

The Service, including its software, branding, interface, and related materials, is owned by Plant Identify or its licensors and is protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, or create derivative works from the Service.

7. Disclaimers

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, error-free performance, or that any plant identification result will be accurate for your intended use.

8. Limitation of Liability

To the maximum extent permitted by law, Plant Identify and its affiliates will not be liable for indirect, incidental, consequential, special, or punitive damages, or for loss of data, profits, goodwill, or business opportunities arising from your use of the Service.

9. Suspension and Termination

We may suspend or terminate access to the Service if we reasonably believe you have violated these Terms, created risk for the Service, or if required by law. You may stop using the Service at any time.

10. Changes to the Service or Terms

We may update these Terms or modify the Service from time to time. Continued use after changes take effect means you accept the updated Terms.
